Terms of service
1. Scope of application
These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online shop www.monte3d.ch between BÖSCHtler GmbH, Hauptstrasse 65, 3860 Meiringen, Switzerland (hereinafter “Monte3D”), and its customers.
Any deviating or conflicting terms and conditions of the customer shall not apply unless expressly confirmed in writing by Monte3D.
2. Offer and conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting an order, the customer makes a binding offer to purchase. The contract is concluded as soon as Monte3D confirms the order by email or dispatches the goods.
3. Prices
All prices are stated in Swiss Francs (CHF).
Unless stated otherwise, prices are:
- inclusive of statutory value added tax
- exclusive of shipping costs
Shipping costs are shown separately during the ordering process. Price and product range changes remain reserved at any time.
4. Payment terms
Monte3D accepts the payment methods offered in the online shop (e.g. credit card, TWINT, PayPal, or others).
The charge is made immediately upon completion of the order. Monte3D reserves the right to exclude individual payment methods without stating reasons.
5. Delivery and shipping
Delivery is made exclusively within Switzerland and the Principality of Liechtenstein to the delivery address provided by the customer.
All delivery times are non-binding unless expressly agreed otherwise in writing.
Partial deliveries are not made. Orders are only fulfilled if all ordered products are available. Should a product unexpectedly not be available, Monte3D reserves the right to cancel the order or adjust it after consultation with the customer.
6. Transfer of risk and notice of defects
The risk passes to the customer upon handover of the goods to the transport company.
The customer is obliged to inspect the goods within a reasonable period after receipt. Obvious defects or damage must be reported to Monte3D in writing immediately, but no later than within 7 days of receipt of the goods.
Hidden defects must be reported immediately after their discovery.
Obvious transport damage must additionally be reported directly to the carrier.
7. Warranty
The statutory warranty provisions of Switzerland apply.
Minor deviations in color, surface, material structure, or technical properties – especially in the case of 3D printing filaments – do not constitute a defect.
In the event of justified defects, Monte3D shall, at its discretion, provide a replacement, remedy the defect (where possible), or grant a price reduction. If replacement or remedy is not possible or unreasonable, Monte3D may rescind the contract.
Any refunds shall, where legally permissible, be made at Monte3D’s discretion in the form of store credit or vouchers. Cash payments or bank transfers are excluded.
8. Liability
Monte3D shall only be liable for damages caused intentionally or by gross negligence.
Liability for indirect damages, consequential damages, loss of profit, or production downtime is excluded to the extent permitted by law.
Liability for personal injury (injury to life, body, or health) remains unaffected within the mandatory scope of the law.
The use of the products is at the customer’s own risk. Monte3D assumes no liability for damages resulting from improper use, incorrect printing settings, or unsuitable hardware.
9. Returns and withdrawal
Returns are only possible after prior consultation with Monte3D.
The following are excluded from exchange in particular:
- opened or used filaments
- consumable materials
- custom-made products
There is no statutory right of withdrawal in Switzerland as exists in the European Union.
10. Retention of title
The goods remain the property of BÖSCHtler GmbH until full payment has been made. Monte3D is entitled to register the retention of title in the relevant register.
11. Data protection
Monte3D processes personal data exclusively in accordance with the applicable data protection laws of Switzerland. Further information is provided in the privacy policy on the website.
12. Intellectual property
All content on monte3d.ch (texts, images, graphics, logos) is protected by copyright. Use without explicit consent is not permitted.
13. Applicable law and place of jurisdiction
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, the mandatory places of jurisdiction under the Swiss Code of Civil Procedure (CPC) apply. Otherwise, the place of jurisdiction is Meiringen (BE).
14. Severability clause
If any provision of these GTC is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
